Privacy Policy

(Curill's policy regarding privacy)

Introduction

Curill respects the privacy of each Customer. Curill has established this Privacy Policy to explain how Data is collected by Curill, and how this Data is used and disclosed. Curill takes the protection of Personal Information very seriously. Curill may process Personal Information only as described in this Privacy Policy.

Definitions & Interpretation

Words defined or assigned a meaning in the Agreement will have that meaning in this Privacy Policy, unless the context clearly indicates otherwise. For purposes of this Privacy Policy: "Data" means any data (including Personal Information) provided to Curill by a Customer and Service Provider (Pathology Lab); and Personal Information means any Data or information about an identifiable Customer, including an email address.

Decline to share

A Customer can decline to share Personal Information with Curill by not registering with Curill.

Children

Curill does not intentionally gather Personal Information about visitors who are under the age of 13.

Collection from browser

Curill automatically receives and records information on Curill's server logs from the browser of a Customer, including an IP address, Curill cookie information, and the page requested. Each Customer should be aware that other web sites visited before entering the web site might place Personal Information within a URL of a Customer during a visit to it, and Curill has no control over such web sites. Accordingly, a subsequent web site that collects URL information may log some Personal Information.

Use

Messages and updates

Curill may send to a Customer administrative messages and email updates regarding its account, the web site, or Services. In some cases, Curill may also send a Customer primarily promotional messages. A Customer can choose to opt-out of promotional messages.

Cookies

Personal Information may be used to improve the web site. Curill may use cookies to save the IDs and session validators of a Customer on its browsers and hard drives, and may use cookies to provide a tailored web site. IP addresses also help Curill to diagnose problems with and to administer the web site.

Targeted content

While a Customer is logged into the web site, Curill may display targeted adverts and other relevant information based on the Data. In a completely automated process, computers process the Data and match it to adverts or related information. Natural persons do not read Data to target adverts or other information without consent. Curill never shares Personal Information with any advertiser, unless a Customer specifically asks Curill to do so. Advertisers receive a record of the total number of impressions and clicks for each advert. They do not receive any Personal Information. If a Customer clicks on an advert, Curill may send a referring URL to the advertiser's site identifying that a Customer is visiting from the web site. Curill does not send Personal Information to advertisers with the referring URL. Once a Customer is on the advertiser's site however, the advertiser may collect Personal Information.

Disclosure

No selling

Curill will not sell, share, or distribute Personal Information. No Personal Information may be disclosed to anyone except as provided in this Privacy Policy.

Marketing purposes

Curill may disclose aggregate statistics (information about the customer population in general terms) about the Data to advertisers or business partners for marketing purposes.

Third party supplier or agents

Curill may need to provide Data to a third party supplier to supply or provide specific Services to a Customer (such as hosting services, support services, shipping services, or payment processing). Each third party supplier is required to only disclose or use the Data to supply or provide the specific Services requested.

Law enforcement

Curill may disclose Data if required: by a subpoena or other judicial or administrative order by law; to protect the safety of any individual or the general public; to prevent violation of the Agreement, or the rights of Curill or any third party. An IP address may be disclosed to a third party: if the law or a legal process requires it; to protect the rights or property of Curill, a Customer, or the general public.

Affiliates

Curill may share Data with an Affiliate, in which case Curill will seek to require the Affiliates to honour this Privacy Policy.

Change of ownership

If Curill undergoes a change in ownership, or a merger with, acquisition by, or sale of assets to, another entity, Curill may assign its rights to the Data it processes to a successor, purchaser, or separate entity. Curill will notify each Customer of the transfer and the Customer may choose to modify its Personal Data at that time. If a Customer is concerned about its Data migrating to a new owner, the User may deactivate or delete its account. Employees. Curill may need to disclose Data to its employees that require the Data to do their jobs.

Abuse

Curill may disclose Data to designated third parties to resolve or investigate abuse complaints. Curill may release Data to assist in attempting to block an abusive Customer or complain to its Internet Service Provider of an abusive Customer.

Security of Data

Curill uses some of the most advanced security measures to protect the Data under its control. All Data is safe, secure, and available only to the Customer and those to whom Customer has granted permissions. In addition, the web site is hosted in a secure server environment that uses a firewall and other advanced security measures to prevent interference or access from outside intruders.

Username & Password

During the registration process, Curill may provide Customer with a username and password. It is the responsibility of each Customer to maintain the confidentiality and security of their password.

Updating or Removing

A Customer may choose to correct or update the Data they have submitted to Curill, by going to their account. To remove any Data from the active database of Curill, a User may deactivate or delete their account. Even if a Customer updates or removes their Data from Curill’s live database, Data may be retained in Curill’s backup files and archives.

Unauthorised Use

Any unauthorised use of Curill information systems is a violation of the Agreement and certain laws, including the section 86 of the ECT Act. Such violations may subject the person to civil and criminal penalties.

Intercept & Monitor

Curill may intercept, monitor, block, filter, read, delete, and disclose any communication over its information system.

Limitation of Liability

Curill is not responsible for, gives no warranties, nor makes any representations in respect of the privacy policies or practices of linked or any third party web sites.

International Customers

Curill may transmit or transfer Personal Information outside the resident jurisdiction of the Customer and therefore across borders. Personal Information may be stored on servers located in countries where laws protecting Personal Information may not be as stringent as the laws in the jurisdiction of the Customer. Personal Information may be processed by Curill in the country where it was collected as well as other countries where laws regarding processing of Personal Information may be less stringent.

Disclaimer: No Warranties

To the fullest extent permissible pursuant to applicable law, Curill and its third-party partners, licensors, and suppliers disclaim all warranties, statutory, express or implied, including, but not limited to, implied warranties of Merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. No advice or information, whether oral or written, obtained by you from Curill or through the services or the site will create any warranty not expressly stated herein. You expressly acknowledge that as used in this section, the term “Curill” includes Curill’s officers, directors, employees, shareholders, agents, licensors, subcontractors and affiliated companies. You expressly agree that use of the services and the site is at your sole risk. It is your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services and other information provided through the site or on the internet generally. You understand and agree that you use, access, download, or otherwise obtain information, or data through the services, the site or any reference sites at your own discretion and risk and that you will be solely responsible for any damage to your property (including your computer system and device) or loss of data that results from the download or use of such material or data. We do not authorize anyone to make any warranty on our behalf and you should not rely on any such statement. This paragraph shall survive termination of this agreement. In no event will Curill be liable for any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of profits, business interruption, loss of programs or information, and the like) arising out of the use of or inability to use the site.

Intellectual Property Rights

We, or our licensors, own all right, title and interest, including, but not limited to all copyright, trademark, patent, trade secret or other proprietary rights (“IP Rights”), in and to the Site, the Platform, the Usage Data. You shall not reproduce, distribute, transmit, modify, create derivative works, display, perform or otherwise use the Site, the Platform or any of the IP Rights, or attempt to reverse engineer, decompile, disassemble, or derive the source code for the Platform or use the Platform or Site to create a competing product. Curill is owned by Visionary Healthtech Pvt. Ltd. Unauthorized use is strictly prohibited. All rights are expressly reserved to Curill.

Service Delivery

The following terms and conditions for service delivery shall govern all services delivery. Any conflicting purchasing terms and conditions of the Customer are hereby expressly rejected. Any such purchasing terms and conditions shall apply only if we expressly confirm them in writing. Booking with us shall be deemed acknowledgement of our terms and conditions.

Prices/Terms and Conditions of Payment:In the case of custom-made packages, we reserve the right to increase the price by a reasonable amount and to deviate to a reasonable extent from the agreed quantity.

Delivery Dates: We will endeavor to adhere to stipulated report-delivery deadlines. However, due to the hazards and peculiar features of lab testing, report-delivery deadlines will not be binding unless expressly agreed otherwise. Our contractual obligations are subject to the concerned labs delivering the correct report to us on time.

Passing of Risk to labs: When samples are transported to the lab, the risk (of accidental loss, destruction or deterioration) (the "Risk") shall pass to the testing lab as soon as we have delivered the samples to the lab.

Errors in Report: If, despite the greatest of care being taken, the reports give rise to complaints, then, obvious errors must be notified without delay, in any case no later than 14 days after receipt of the report, and hidden errors must be notified without delay after their discovery, otherwise the reports shall be deemed accepted.

Limitation of Liability: If subsequent performance cannot be rendered, the Customer may ,notwithstanding any claims for compensatory damages, rescind the agreement or reduce the contractual fee. The Customer may not demand compensation for expenses incurred in vain. For loss or damage caused by delay due to ordinary negligence, we shall be liable for up to only 5% of the booking price agreed with us.

Documents: Documents supplied by us may not be copied or made available to third parties, or used for any purpose other than the agreed purpose.

Relevant Information regarding Electronic Commerce: In case we use electronic means for the conclusion of a booking with regard to any of services the Customer waives its rights regarding a) availability and explanation of a system to recognize and correct input errors before submitting an order and b) the supply of information regarding (i) the necessary steps to conclude a booking, (ii) electronic storage of the booking so concluded and its accessibility to the Customer, (iii) the possible languages available for booking.

Refund & Cancellation Policy

This cancellation and refund policy governs the cancellation of client or patients order service with Curill offered by Visionary Healthtech. Pvt. Ltd, a company incorporated under the Companies Act, 1956 of India, having its corporate office at 130, Vardhman Star Mall, Sector 19, Faridbad Haryana - 121002.

Client can cancel the order any time before the services start. Service Start is the time when Phlebotomist of "Curill" or "respective Lab" left from the location to the respective client chosen Address. In case of this, full refund would be processed in case of Online Payments.

Canceling the request after the services start would bring the nominal cancellation charges as "administrative cost" of Rs. 100 in case of online transaction.

In case of delay in the services from company, customer can ask for full refund and no amount would be deducted as per cancellation.

In case if client is not happy with Curill Services (before sending the sample to the lab), they can inform the same by calling the inbound number or sending the email at team@curill.com with "order ID" mentioned in the subject line. In such cases, sample would not be processed and full refund would be processed.

In case of any issue around the reports, client can inform the same within 1 day of reports published. In such cases we can ask the "respective lab" to repeat the test on the sample collected from the client.

Any issues raised after 48 hours of reports published can not be entertained as new sample collection would be required in the case and would be treated as new order and would be chargable as normal rates.

Refunds would be processed within 7-10 business days of the cancellation.

Relevant Information regarding Electronic Commerce: In case we use electronic means for the conclusion of a booking with regard to any of services the Customer waives its rights regarding a) availability and explanation of a system to recognize and correct input errors before submitting an order and b) the supply of information regarding (i) the necessary steps to conclude a booking, (ii) electronic storage of the booking so concluded and its accessibility to the Customer, (iii) the possible languages available for booking.

Applicable Law and Judicial Forum

Substantive laws of Republic of India shall apply to all legal relationships and transactions established by this purchase agreement.

The judicial forum for both parties, including for bill of contract matters, is our principal place of business (registered office). If we become the plaintiff in litigation, then we are also entitled to bring an action in the jurisdiction of the Customer's principal place of business (registered office).
